TERMS AND CONDITIONS

1. PREAMBLE

1.1. The online portal BORIklik (hereinafter also: “online portal” or “BORIklik”) is operated by Birografika BORI d.o.o. (hereinafter: “Birografika BORI d.o.o.”, “we”, “operator”), which is a commercial company registered in Slovenia (European Union, “EU”) with its registered office at Linhartova cesta 1, SI-1000 Ljubljana, under company registration number 5183472000, registered at the District Court in Ljubljana, VAT ID SI16466543.

1.2. BORIklik is an online portal that enables private individuals to enter into transactions (purchase) in accordance with these terms.

1.3. These general terms govern only the relationship between you and Birografika BORI d.o.o. in its role as operator of the BORIklik online portal.

1.4. You can place an order on BORIklik only after registering. By registering, you acquire, as a visitor to the portal, the right to make purchases. When registering, you must provide at least the following personal data (first and last name, billing address, delivery address, email address, telephone number) and confirm your agreement with these general terms. The terms and conditions are publicly accessible on the BORIklik portal.

2. PURCHASE OF PRODUCT OR ORDERING A SERVICE

2.1. These general terms apply to all product orders. Please read them carefully before ordering via the portal and ensure you understand them. By submitting an order, you confirm that you fully accept these terms of use.

2.2. These terms (and any other documents referred to herein) may be amended or supplemented from time to time.

2.3. By purchasing a product or service through the portal, a legal relationship is established between the buyer and Birografika BORI d.o.o., with whom the purchase was made.

3. TERMS OF USE OF THE ONLINE PORTAL

3.1. The portal is accessible at the main domain https://www.boriklik.si, and certain supplementary domains may redirect you to the main domain. To use the services and functionalities, you need internet access and a device with a modern browser. You are responsible for the software required for proper operation of the portal and for ensuring your hardware and internet connection function correctly.

3.2. Birografika BORI d.o.o. accepts no liability for any consequences arising from the use of its website or its content. It also bears no responsibility for any consequences resulting from the information contained therein, including inaccuracies or damages caused by use of incomplete or incorrect information.

3.3. You may use the portal’s content solely for purchasing, information, and educational purposes for personal, non-commercial use. All content is copyright-protected. Any other use, copying, publication, reproduction, transformation, or distribution of the content or parts thereof without permission from Birografika BORI d.o.o. is prohibited.

3.4. Ordering on the portal is possible 24 hours a day, every day of the year.

3.5. You can create a user account and, as a registered user, continue the purchase process. Registered users are private individuals who provide the requested data during registration. Your user account allows you to:

• manage your personal data (first and last name, billing address, delivery address, email address, telephone number, password);
• place orders multiple times without re-entering your personal data;
• receive information about payment of orders and other details;
• review past orders.

3.6. You can create your user account by clicking “Create account.”

3.7. When registering and creating an account, you must set a password and provide all required data (company name, first and last name, telephone number, email, street and house number, postal code, city, country). If your delivery and billing addresses differ, you must also provide the delivery details. Providing false information or issuing invoices in another person’s name is a criminal offense.

3.8. During registration, the portal will send an email with a link to confirm your address and activate your account. Once confirmed, your user account is created. Registered visitors must keep their data accurate and up to date; personal data can be changed at any time in the account profile.

3.9. Each registered user receives login credentials composed of a username (email) and password. By entering correct credentials, the user logs into the portal. Passwords are secret and known only to the user; they are stored encrypted on the operator’s side to ensure a high level of information security.

4. RIGHTS AND OBLIGATIONS OF THE OPERATOR

4.1. Birografika BORI d.o.o. reserves the right to terminate your user account if you violate the terms of use or applicable law.

4.2. You may delete your user account any time in your profile settings, or request its deletion by emailing Birografika BORI d.o.o. at boriklik@birografikabori.si. Such deletion is permanent and irreversible. If deleted, you may re-register and create a new account.

4.3. Birografika BORI d.o.o. reserves the right not to fulfill an order if there are justified reasons. In such cases, any payments made will be refunded to the buyer.

5. OPERATION OF THE ONLINE PORTAL

5.1. Birografika BORI d.o.o. will strive to ensure uninterrupted operation of the portal but does not guarantee it will be continuously available or error-free.

5.2. The portal is continually updated, which may cause temporary or permanent disruptions without notice. Birografika BORI d.o.o. is not liable for such disruptions or their consequences; users are not entitled to compensation.

6. ORDER SUBMISSION PROCEDURE

6.1. Before submitting an order, each registered buyer must verify and regularly update their data. Follow the ordering steps carefully. For questions, contact our sales department at boriklik@birografikabori.si or use the “Chat” feature, or call 01/47-20-450 during business hours.

6.2. You place an order by following these steps:

Select the desired product or service and click “Start creating.” The portal’s tool lets you securely upload and prepare files for printing and design your project. You must save the project for later or click “Order” to add it to your cart. In the cart, you can add or remove projects and set quantities. If you agree with the summary, click “Proceed to checkout,” choose delivery and billing addresses, payment method, shipping method, add any message, and enter a promotional code if available. Finally, click “Submit my order.” If you leave a project in the cart, you will receive an abandoned cart reminder by email within 24 hours of project creation.

6.3. After successful submission, you will receive an email confirming payment. This message confirms your order has been placed and paid for, and includes order number, date and time, items and quantities, and total amount. If you do not receive confirmation, notify sales at boriklik@briografikabori.si.

6.4. Birografika BORI d.o.o. will produce the ordered items within the agreed timeframe unless fulfillment becomes impossible (see next clause). Products will then be prepared for pickup or shipment as chosen. You will be notified by email when ready.

6.5. Up until payment confirmation, Birografika BORI d.o.o. may cancel any order it deems impossible to fulfill under the stated conditions. It may also reject orders that violate usage rules without explanation. The company is not materially liable for irregularly executed orders or those not in accordance with these terms. Orders may also be declined due to unpredictable technical or other circumstances preventing fulfillment in the required quantity or quality.

6.6. The sales contract between Birografika BORI d.o.o. and the buyer is concluded when the buyer receives payment confirmation by email. From that moment, prices and conditions are fixed for both parties.

6.7. Registered buyers can access their order details and past orders at any time via the portal.

7. PAYMENT TERMS

7.1. Prices displayed on the portal apply at the time of order submission and cannot change thereafter.

7.2. All final prices on BORIklik include VAT and are in EUR.

7.3. Product prices do not include delivery/shipping costs, which will be added if the buyer chooses postal delivery.

7.4. Payment is made on the website without redirection to third-party providers. Card data entered for payment are encrypted and sent directly to the payment system provider; we do not view, process, or store them. All such data are securely held by Stripe, ensuring high information security for the buyer.

7.5. From time to time, visitors may receive promotional codes via the portal or other digital channels. Codes are time-limited and must be used within the specified period. To apply, enter the code in the designated field before clicking “Submit my order” and click “Apply.” Discounts apply to the total order or to specific items/shipping costs, depending on the code.

8. DELIVERY

8.1. Ordered products may be picked up at Birografika BORI d.o.o., Ljubljana, Dunajska 48 (copy shop), or shipped by post within the agreed term. If shipping is not possible, you will be notified and items will be sent as soon as possible.

8.2. Delivery is carried out by a courier service. If delivery fails or you are absent, the courier will leave a notice.

8.3. Delivery costs are added to the order price and shown on the invoice. They are calculated before order finalization; no additional charges apply after payment.

8.4. Birografika BORI d.o.o. is not responsible for delays, loss, or damage during transport by the courier service, nor for loss or damage during returns by post.

8.5. If you receive a physically damaged package or packaging, you must immediately notify the courier and initiate a claim.

8.6. Delivery is complete when the products are delivered and you confirm receipt by signing.

8.7. If you refuse the shipment or fail to collect it within 8 working days of attempted delivery, you must cover return and possible reshipment costs, as per these terms you agreed upon ordering.

8.8. All applicable laws and regulations of the destination country must be observed. We are not liable for buyer’s violations.

9. RIGHT OF WITHDRAWAL OR RETURN OF GOODS AND REFUND

9.1. Printing services and products on the portal mostly constitute goods made to customer specifications. Prices depend on market fluctuations beyond Birografika BORI d.o.o.’s control that may occur during the withdrawal period. Under applicable law, custom-made graphic–printing services resulting in unique items are exempt from withdrawal rights.

10. NON-CONFORMITY AND CLAIMS

10.1. Birografika BORI d.o.o. must deliver products in accordance with the contract and is liable for any non-conformities at delivery.

10.2. Printing materials may expand due to water or temperature, affecting print quality. All paper deformations and technological specifics must be considered during file preparation. Birografika BORI d.o.o. is not liable for failures to follow printing instructions or for business or material damage caused by printing or material defects.

Birografika BORI d.o.o. is not liable for errors in prints resulting from incorrectly prepared files by you, third parties, or your external providers.

10.3. If you believe received products do not conform to your requirements, you may submit a claim via email to boriklik@birografikabori.si.

10.4. Birografika BORI d.o.o. will seek the best solution according to your wishes and its capabilities. If an error is acknowledged, the product will be replaced. If replacement is not possible, you return the product and receive a refund.

10.5. Claims will be processed within 8 working days of receipt of rejected products by Birografika BORI d.o.o.

11. INTELLECTUAL PROPERTY RIGHTS

11.1. All texts, comments, works, illustrations, and images on BORIklik, including code and UI components, are protected by copyright and/or other intellectual property rights for their full term worldwide. Any full or partial reproduction of the portal or its elements is strictly prohibited.

11.2. Birografika BORI d.o.o. grants you an exclusive, personal, non-transferable right to use the portal and its services for personal use only, for the duration of portal usage. This grant does not transfer any intellectual or commercial rights to you.

12. PERSONAL DATA PROCESSING

12.1. Birografika BORI d.o.o. processes your personal data in accordance with laws, these terms, and the Privacy Policy of the BORIklik portal.

Please read these documents carefully as they contain important conditions. We collect (process) your personal data:

• upon registration (name, surname, billing and delivery address, email, phone);
• when placing an order (billing and delivery details, email, phone, images revealing personal information, payment data, time and subject of purchase);
• for order processing (same as above plus invoice data, image materials);
• for analytics (clicks, time spent) and commercial message engagement (opens, clicks), anonymized for analytics;
• to handle your inquiries, complaints, claims (name, contact details, content and subject of requests);
• with your explicit consent, for the purposes you agreed upon registration.

12.2. As data controller, we will store, protect, and process your personal data in accordance with the highest security standards and applicable law (GDPR etc.), ensuring protection against loss, damage, unauthorized access, except for contractual processors required to fulfill your purchase.

12.3. By creating an account, you allow Birografika BORI d.o.o. to use your data to provide and improve portal services, including sharing with external software developers and security engineers as contractual processors.

12.4. When you order, we may share your personal data (name, address, delivery details, phone, email) with our printing service partners to fulfill your purchase.

12.5. To access certain services or your data, you must log into your account.

12.6. Purchase details (project files, description, quantity, price, date) and your personal data (name, address, email, phone) are stored.

12.7. You are informed that:

• your data will only be processed for the purpose for which it was collected;
• data processed based on consent will be retained until you withdraw it; other data will be kept for the statutory retention period;
• you have the right to access, correct, delete, or restrict processing of your data, object to processing, and request data portability;
• to exercise these rights, send a written request to Birografika BORI d.o.o., Linhartova 1, 1000 Ljubljana, marked “for GDPR,” or email boriklik@birografikabori.si;
• you may lodge a complaint with the Slovenian Information Commissioner;
• contractual processors bound to confidentiality may process your data;
• data will not be disclosed to third parties except those with legal or contractual grounds.

12.8. The portal allows you to view and update your personal data as needed.

12.9. For more information, see the Privacy Policy of the portal.

12.10. All cookie rules in the Privacy Policy and this document apply. You can review and adjust your cookie preferences on your first visit.

13. SECURITY AND PRIVACY

13.1. Birografika BORI d.o.o. implements technological and organizational measures for the highest security level. Sensitive personal and transaction data are transmitted via SSL with up to 256-bit encryption before leaving your browser.

13.2. Payments are handled by reputable banking institutions with real-time authorization checks. We do not store or have access to your payment card data.

13.3. Account deletion requests must be sent from the registered email. You may also delete your account in settings.

14. COOKIES

Cookies that help us properly display content and enable the operation of forms, the shopping cart, and other essential elements of the website.

15. GENERAL PROVISIONS

15.1. We may assign our rights and obligations under the contract to another organization without affecting your rights or our obligations. You will be informed appropriately if this occurs.

15.2. You may transfer your rights or obligations under these terms only with our written consent.

15.3. If any provision of these terms conflicts with applicable law, it does not affect the validity of the remaining provisions. The parties will agree on a new provision consistent with the law and the purpose of these terms.

15.4. The contractual relationship is governed by Slovenian law. In case of dispute over translated versions, the Slovenian version prevails. Disputes will first be settled amicably; failing agreement, the competent court in Ljubljana has jurisdiction.

15.5. Our failure to enforce any right under these terms does not constitute a waiver of that right. Any waiver must be in writing.

15.6. These terms may change in the following cases:

• changes in order processing or payment methods;
• changes in applicable laws or regulatory requirements;
• other changes as needed.

15.7. In case of changes to these terms, Birografika BORI d.o.o. will publish the new terms on the portal at least one day before they take effect.

15.8. These terms take effect on the date of publication on the website.
